WInternational trade and growing competition between companies in attracting consumers have led to an exponential increase in the violation of distinctive signs of industrial property, in terms of counterfeit, imitation and illegal use of the brand. It is a global phenomenon that has taken an overwhelming dimension with
the growth of online commerce. This article intends to analyze the diff erence between the institutes of imitation, usurpation and counterfeit of the trademark, as well as unfair competition.
