Abstract

Looking through a legal, doctrinal, and jurisprudential analysis, this research is related to possible issues from the digital transformation process, specially from artifi cial intelligence (AI). Restrictions and ethics are discussed. Also, artifi cial intelligence within the contract’s scope is discussed. Critical and optimistic perspectives are combined facing what the present and future hold, by analyzing the impact felt by insurance companies and by the consumer. The primary objective of this paper involves the refl ection about existing problems related to AI, especially in terms of insurance. It analysis the insuffi ciency of the law to regulate this matter, as well as the consequences that the consumers feel with the advent of this technology. It contributes for the elucidation of the scientific society about AI and private contracts, namely its impact on insurance contracts and on the consumer.
