PROTECTION OF EMPLOYEES' CLAIMS IN INSOLVENCY: BRIEF COMMENTS

Abstract

This article aims to analyse the protection of workers’ claims in the context of insolvency. We will start the article with an approach to labour claims, which can be divided into remuneration claims and compensatory or indemnity claims, taking the opportunity to analyse some of the doctrinal and jurisprudential issues that we consider to be most relevant (e.g., the nature of the debts and the respective payment regime). And in the central part of the article, we will analyse the diff erent types of means of protection of workers’ credits and the respective scope of action in insolvency - namely, the privileges of creditor claims and the Wage Guarantee Fund.
